These Terms & Conditions (“Terms”) govern all bookings, payments, and use of services provided by Riobian Safaris (“Company”, “we”, “us”, or “our”), a safari tour operator registered in Kenya. By accessing our website, requesting a quotation, or making any payment, you confirm that you have read, understood, and agreed to be bound by these Terms.
1. Bookings & Payments
1.1 A 30% non-refundable deposit is required to confirm all bookings unless the booking is paid in full at the time of confirmation.
1.2 The remaining balance must be paid no later than 30 days prior to the scheduled departure date, unless otherwise agreed in writing.
1.3 Failure to pay the balance by the due date may result in cancellation of the booking without refund of any amounts already paid.
1.4 All payments are processed directly by Riobian Safaris via its official website https://riobian.com or through secure payment links issued by Riobian Safaris.
Riobian Safaris does not accept payments on behalf of third-party travel agencies, and no payments are processed on external agency websites.
2. Prices & Availability
2.1 All safari packages are bespoke and subject to availability at the time of booking.
2.2 Prices may vary due to seasonality, accommodation availability, itinerary changes, government fees, or park regulations.
2.3 Final pricing is confirmed at the time of booking confirmation and acceptance of payment.
3. Service Inclusions
Unless otherwise specified in the confirmed itinerary, safari packages may include:
- Accommodation as stated
- Park entry and conservation fees
- Ground transportation
- Professional guide services
- Meals and beverages as outlined in the itinerary
4. Exclusions
Unless expressly included, the following are excluded:
- International and domestic flights
- Visa and immigration fees
- Travel insurance
- Tips, gratuities, souvenirs, and personal expenses
- Optional activities not stated in the itinerary
5. Cancellations, Amendments & Refunds
5.1 Due to the bespoke and pre-booked nature of safari travel services, payments are generally non-refundable once confirmed, except where otherwise required by applicable law or expressly agreed in writing.
5.2 No refunds are provided for:
- No-shows
- Early departures
- Missed services due to client error or late arrival
5.3 Amendments requested more than 30 days prior to departure may incur a minimum administrative fee of USD 150, in addition to any supplier-imposed charges, and are subject to availability.
6. Force Majeure
Riobian Safaris is not liable for delays, changes, or cancellations caused by events beyond its reasonable control, including but not limited to:
- Natural disasters
- Political unrest
- Pandemics or public health emergencies
- Airline delays or cancellations
- Government restrictions
In such circumstances, Riobian Safaris may, at its discretion, offer a credit voucher valid for up to six (6) months, subject to rebooking fees and availability.
7. Travel Documents & Insurance
7.1 Clients are solely responsible for obtaining valid passports, visas, vaccinations, and any other required travel documents.
7.2 Comprehensive travel insurance covering medical emergencies, cancellations, evacuations, and trip interruptions is strongly recommended.
8. Health & Fitness
8.1 Clients are responsible for ensuring they are medically fit to travel.
8.2 Any medical conditions, dietary requirements, or accessibility needs must be disclosed at the time of booking so reasonable accommodations can be considered.
9. Liability & Responsibility
9.1 Riobian Safaris arranges and coordinates travel services provided by independent third-party suppliers, including accommodation providers, transport operators, and airlines.
9.2 Riobian Safaris is not liable for loss, damage, injury, delay, or inconvenience caused by the acts or omissions of such third-party suppliers.
9.3 To the maximum extent permitted by law, the Company’s total liability shall not exceed the total amount paid by the client for the booked services.
10. Conduct & Safety
10.1 Riobian Safaris reserves the right to remove any guest from a safari, without refund, if the guest:
- Engages in disruptive or unsafe behavior
- Endangers other guests, staff, or wildlife
- Breaches park rules, local laws, or safety instructions
11. Agency & Referral Bookings
11.1 Riobian Safaris may work with independent tour and travel agencies who introduce customers to its services.
11.2 Such agencies act solely as referral or sales partners and do not process payments, act as sub-merchants, or operate under the Company’s merchant account.
11.3 All bookings are confirmed directly with Riobian Safaris, and all payments are made directly to Riobian Safaris under these Terms.
12. Intellectual Property
All content on the website, including text, images, logos, and branding, is the intellectual property of Riobian Safaris and may not be copied, reproduced, or distributed without prior written consent.
13. Customer Acknowledgment
By making a payment, the customer confirms that they have reviewed and accepted these Terms & Conditions prior to completing the booking.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of Kenya.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.
Customers booking from outside Kenya acknowledge that services are provided by a Kenya-registered operator and governed accordingly.
